If you do not agree with any of these terms, you are prohibited from using or accessing this site, and prohibited from hiring our transportation portfolio of services. The materials contained in this marketplace platform are made available by South Bend Taxi Eagle Cab and its presiding companies, subsidiaries, affiliates, and representative directors. The website platform materials and related Eagle Cab company identity materials are protected by applicable copyright and trademark law. Unless otherwise stated, the contents of this website and related social media platforms including, but not limited to, the text videos and images contained herein/therein and their arrangement are the property of South Bend Taxi Eagle Cab and trademarks used or referred to in this website and on other digital/social/commercial promotion platforms are the property of our respective company directors.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software or shareware) on South Bend Taxi's website for personal, non-commercial sharing and transitory viewing only. In no event will Eagle Cab South Bend Taxi or its suppliers and affiliate companies be liable to any party for any direct, indirect, incidental, special, exemplary, consequential, or other damages (including, but not limited to, lost profits, business interruption, loss of programs or data) without regard to the form of action and whether in contract, tort, negligence, strict liability, or otherwise, arising out of or in connection with this site. Any content on or accessed through this site or any site service linked to, provided by, or any copying, displaying, or use thereof, of South Bend Taxi Eagle Cab and South Bend Taxi Eagle Cab authorized representatives are recused from liability even if representatives have been notified orally or in writing of the possibility of such liability and damages. All operators of Eagle Cab South Bend Taxi or driver/operators recommended by South Bend Taxi whether online, via phone, or any other means act as independent contractors and are require to 1) abide by the City of South Bend for hire transportation regulations and 2) carry their own valid & approved City of South Bend & State of Indiana U.S.A licensing and commercial insurance. Eagle Cab South Bend Taxi and its portfolio of affiliated services/companies are not liable for any direct, indirect, incidental, special, exemplary, consequential, monetary, bodily injury, physical, psychological, or any other damages pertained to your use of recommended independent contractor driver/operators.
5. Accuracy of Materials & Links
The materials appearing on South Bend Taxi's website could include technical, typographical, or photographic errors. South Bend Taxi does not warrant that any of the materials on its website are accurate, complete or current. Eagle Cab South Bend Taxi may make changes to the materials contained on its website at any time without notice. However South Bend Taxi does not make any commitment to update the materials. Eagle Cab South Bend Taxi representatives have not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site/s. The inclusion of any link does not imply endorsement by South Bend Taxi of the site. Use of any such linked website is at the user's own entitlement and risk.
6. Submissions
South Bend Taxi Eagle Cab and affiliated companies and representatives do not accept unauthorized idea submissions outside of established business relationships. To protect the interests of our current clients and ourselves, we must treat the issue of such submissions with care. Without a clear business relationship, South Bend Taxi cannot and does not treat any such submissions in confidence. Accordingly, please do not communicate unauthorized idea submissions to South Bend Taxi and its affiliates or through this website. Any ideas disclosed to South Bend Taxi outside a pre-existing and documented confidential business relationship are not confidential and South Bend Taxi Eagle Cab may therefore develop, use and freely disclose or publish similar ideas without crediting you, compensating you or accounting to you. Idea submissions and development or lack thereof cannot limit competitive forces or natural business and industry trends undertaken by South Bend Taxi or any other taxi/livery service. By submitting an idea or feedback or reviews and recommendations or other detailed submission to South Bend Taxi Eagle Cab and its affiliated companies and even through our digital social platforms, you agree to be bound by the terms of this stated submissions policy.
7. Livery Services
All charter and taxi/livery service deposits are NON refundable. Reservations should NOT exceed time limits. There is a 10 minute complementary allowance beyond time limit, client is responsible for a full hour fee post the 10 minute allowance. Southbendtaxi Eagle Cab is not liable in the event of mechanical breakdown while on transit or charter and will only be responsible in collaboration with client to arrange alternative mode of transportation. Taxi/livery or charter booking driver operator if compensated in FULL and in advance can reimburse client for the leftover distance of travel beyond breakdown. The client assumes full financial liability for any damage caused to the vehicle/s during the duration of the rental by them or any members of their party.
Any fines for alcohol consumption while vehicle is in operation whereby prohibited by law will be paid for by the client/passengers. A fee may be asserted for cleanup sanitation. Smoking and or drug use in public and livery vehicles is STRICTLY prohibited by law. It is Illegal to stand through the sunroof and we do not advise loading vehicles beyond seating capacity. Passengers must not distract drivers especially at road/rail intersections and crossings. The driver has the authorization and right to terminate the trip without refund or reimbursement (if there is blatant indiscretion on the part of the client(s).
All sales are final Southbendtaxi Eagle Cab is not responsible for refunds, exchanges, or credits in the case of client hiring then lack of utilization of services. We are not responsible for delays or termination of 3rd party travel itineraries (airlines, cruise lines, rail lines, bus lines etc.) We are not responsible for delays or termination of travel in winter caused by unsafe road conditions (i.e. flooded, unsalted, hazardous, road construction, accidents, etc.) We are not responsible for delays and termination of travel caused by health ordinances such as during pandemics. We are not responsible and don’t refund for articles and items lost or left in vehicles. Invoiced balances to be paid to the billing contact on the trip date before the beginning of the trip. Lack of invoiced or remaining balance of payment beyond (30) thirty days can be subject to debt collections or legal recourse.
8. Livery Drivers
South Bend Taxi markets and promotes taxicab/transportation services both online and offline and is operated by and Eagle Cab Company representatives in South Bend, IN. Eagle Cab Co. drivers are independent contractors who provide transportation services and fulfill requests of customers whether referred to by South Bend Taxi or customers gained by any other format including direct arrangements from customer clients to driver/operators and referral from other Taxi Services or calls and staged pickups from Airports and other locations.
Eagle Cab Co. and general City of South Bend Livery and Taxi driver/operators are independently responsible to obey general driving rules and laws governing the operation of vehicles over the road in the City of South Bend, the State of Indiana and the United States. Drivers must adhere to requirements set by the State of Indiana and the City of South Bend transportation governing bureaus including the provisions set for Taxicab Licenses & Inspections. Drivers need to abide by the Municipal Code including the provisions determining Code of Conduct, Taxi-rates, Vehicle Maintenance, City & Meter Inspections, and Commercial Insurance provisions as set by the City of South Bend IN. Neither is South Bend Taxi Eagle Cab its owners or management are liable for independent taxi driver violations of set standards and rules by the City of South Bend and presiding Local, State, and Federal laws governing the operation of Taxi/Livery/Charter vehicles. South Bend Taxi marketplace (digital) platform and its representatives refer independent drivers to customers or refer customers to drivers are therefore not liable for any (physical) interaction between drivers and customers that cause monetary damages or the involvement of any authoritative body including legal or judicial review.
South Bend Taxi is not obligated to provide referrals and has the right to terminate the referral of customers to independent drivers, just as drivers are not mandated to accept referrals from South Bend Taxi Eagle Cab or any other Taxi Service, and in turn have the right to terminate the referral service and any referral fee structure as agreed. Drivers are responsible to inform the representatives at South Bend Taxi Eagle Cab or their respective Taxi Companies and the City of South Bend IN if and when unable to continue the operation of Taxicab/Livery Charter vehicles. South Bend Taxi is not liable for any physical, emotional, psychological, or monetary damages in lieu of its business referral service to independent drivers.
South Bend Taxi may revise these terms of service at any time without notice. By acceptance of referral business, drivers agree to be bound by these terms or the then current version of the terms of service. If Taxi/Livery drivers object to the terms of service, they are responsible to refuse the referral business or turn down opportunities from South Bend Taxi Eagle Cab. By having engaged in referrals and business with South Bend Taxi, drivers agree to be bound by a service level non-compete agreement as interpreted by trademark and copyright laws in the State of Indiana and applicable Federal laws. Any usage of South Bend Taxi Eagle Cab name, likeness, identity, branding, content, or other digital social and print attributes without permission for an exploitative or commercial purpose is subject or warranted legal grounds for legal action. Independent contractor drivers are NOT allowed to establish, market or represent their own taxi/livery services or farm out, dispatch or hire Eagle Cab Co. or other drivers. Any legal action proceeding related to South Bend Taxi platform, Eagle Cab Co. & affiliated driver operators, or representatives, and customers shall be governed by the Laws of Indiana.
9. Lost & Found Item
If you think you may have left or lost an item in our vehicles, please contact us and provide your date and time of trip, vehicle make model identity and the pickup and drop off location. South Bend Taxi makes an effort to return items or property that is found upon the customer’s request. Beware that South Bend Taxi Eagle Cab is not liable for any lost, left behind, abandoned, or forgotten items, property, or luggage within our business premises, our referred Taxi vehicles or during the course of any other interaction between you and South Bend Taxi. In use of our services, you acknowledge that South Bend Taxi is not responsible for finding, replacing, accounting or compensating for lost, left behind, forgotten, or abandoned items, and furthermore, your items, property, and or luggage are not governed under our commercial auto insurance policy.
10. Governing Law
South Bend Taxi maintains this website platform and affiliated digital services in Indiana, U.S.A. and you agree that these terms of use and any legal action proceeding or relating to this marketplace platform shall be governed by the laws of the State of Indiana without reference to its choice of law rules. If you attempt to bring any legal proceedings against South Bend Taxi Eagle Cab, you specifically acknowledge that South Bend Taxi Eagle Cab is free to choose the jurisdiction of our preference as to where such action against us may be held. As you have agreed by using this site to choose the laws of the State of Indiana to govern any such proceedings, we will probably choose to defend any such action in Indiana and we can make this decision entirely as it suits us, without regard to where in the world you are located, or from where in the world you visited this digital platform.
You are responsible for complying with the laws of the jurisdiction from which you are accessing this website and you agree that you will not access or use the information on this website platform in violation of such laws. Unless expressly stated otherwise herein, any information submitted by you through this website shall be deemed non-confidential and non-proprietary. You represent that you have the lawful right to submit such information and agree that you will not submit any information unless you are of legal age and legally consent or are entitled to do so. Because of the open nature of the Internet, we recommend that you not upload or submit information you consider sensitive or confidential.
You agree that in the event of any breach or threatened breach, South Bend Taxi Eagle Cab and its representatives may obtain monetary damages in addition to any other legal remedies which may be available, including reimbursement of costs, fines and reasonable attorney fees – as such equitable relief may be necessary to protect South Bend Taxi against any such breach or threatened breach. If any provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect.
